1. Scope and agreement
These terms govern use of moonfreightusa.com and the associated online services operated by Moon Express Inc. (“Moon Express,” “we,” or “us”). Please read them before using our forms and portals. When you submit a form that identifies these terms, you agree to them. If you act for a business, you confirm you have authority to do so. If you do not agree, do not submit information through these services and contact us directly.
Our privacy policy explains how we handle personal information. These website terms do not replace a separately agreed transportation, warehousing, rental, employment, or contractor agreement.
2. Quotes, pricing, and availability
Online quotes and displayed prices are estimates based on the information entered, available mileage information, and current website settings. They are not a confirmed booking, guaranteed capacity, or a binding offer to transport or store freight. Dispatch must confirm the scope, dates, equipment, availability, and final charges.
Final pricing may depend on actual locations and mileage, weight, commodity, dimensions, handling requirements, timing, fuel, tolls, accessorial services, and other agreed requirements. An automated confirmation that a request was received does not confirm the service. Contact dispatch about errors or changes before relying on a quote.
ZIP-to-ZIP mileage and map links are planning aids. They are not truck-specific navigation or a guarantee that a route meets vehicle, weight, height, weather, or road restrictions.
3. Transportation and other service agreements
Actual services are governed by applicable law and the documents agreed for the transaction, such as a written rate confirmation, transportation agreement, bill of lading, warehouse receipt, or rental agreement. Charges, cargo claims, service commitments, insurance, payment obligations, and liability for those services must be addressed under those documents and applicable law.
These website terms do not establish a cargo-liability limit, waive mandatory transportation rights, shorten a statutory claim period, or change a signed service agreement. In a conflict, applicable law and the relevant service agreement control the service transaction.
4. Driver applications
An application is an expression of interest, not an offer or guarantee of employment, contracting work, compensation, equipment, or a particular route. Information must be accurate and current. Any hiring decision, verification, screening, or engagement is subject to the separate notices, permissions, requirements, and agreements applicable to that process. This website application alone does not authorize a background check.
5. Reports, inspections, and portal access
Enter your own name and accurate trip, expense, and inspection information. Use staff access only if authorized and protect account credentials and shared devices. Do not access, alter, or submit another person’s records without permission. Report mistakes or suspected unauthorized access promptly.
Submitting a trip report saves a company copy separately from the mail or sharing app used to email the PDF. Opening a mail draft or sharing menu does not establish that an email was sent or delivered. Check the recipient, attach the PDF when required, and finish sending in your mail app. Keep records you need and contact dispatch if a submission fails.
A portal status, checklist submission, or inspection streak is not a certification that equipment is safe or authorization to operate it. Follow company safety procedures and communicate urgent defects directly to dispatch or the shop. Online submissions are not an emergency notification service.
6. Acceptable use and submitted content
Use the website lawfully and only for its intended business purposes. Do not impersonate others, submit knowingly false reports, upload malicious or unlawful material, bypass access controls, collect private records without permission, disrupt the service, or use automated requests to abuse its resources.
You are responsible for having the necessary rights and permission for information and photos you submit. You retain ownership of your content and grant Moon Express permission to receive, store, process, reproduce, and share it as needed to respond to your request, operate the services, and maintain business records as described in the privacy policy. This permission is not a transfer of ownership or a general right to use your content in advertising.
7. Website content and third-party services
Moon Express branding and website materials belong to Moon Express or their respective owners. You may use them to evaluate our services and for authorized company work. Do not reuse company logos, photos, or other protected material for unrelated commercial purposes without permission.
The website may link to maps, reviews, email tools, videos, and other services operated by third parties. Their own terms and privacy policies apply. We do not control their availability, content, delivery, or security.
8. Availability and website warranties
We may maintain, update, or change website features. Internet connections, third-party providers, browser settings, and device storage can affect access, drafts, downloads, and submissions.
To the extent permitted by law, the website and its informational tools are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access, error-free estimates, or permanent availability of a local draft. Express obligations in a separate service agreement remain in effect.
9. Limits of website liability
To the extent permitted by applicable law, Moon Express is not liable for indirect, incidental, special, or consequential losses, including lost profits or business interruption, arising from use of or inability to use this website or its informational tools.
Nothing in these terms excludes liability that cannot lawfully be excluded, including any non-waivable responsibility for fraud, willful misconduct, or gross negligence. These website limitations do not change cargo claims, transportation or storage liability, obligations under a separate agreement, or other rights that applicable law protects.
10. Access restrictions
We may restrict access reasonably necessary to address unauthorized use, security concerns, violations of these terms, or legal requirements. Restricting website access does not cancel obligations under a separate agreement or prevent you from making a lawful request about your records using the contact details below.
11. Governing law and questions
These website terms are governed by North Carolina law, except where applicable federal law or other mandatory law controls. They do not remove non-waivable rights provided by another applicable jurisdiction. Please contact us first about website concerns so we can try to resolve them. No mandatory arbitration agreement or class-action waiver is created by these terms.
12. Changes and remaining provisions
We may revise these terms by posting a new effective date and providing any notice or agreement required by law. Changes apply prospectively and do not retroactively alter an agreed shipment, employment relationship, or other separate contract. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision does not waive it.
